PLEASE TAKE NOTICE THAT the Board of Appeals of the Incorporated Village of Sands Point will convene to hold public hearings on Monday, November 19, 2018 at six-thirty o’clock in the evening at Village Hall, 26 Tibbits Lane on the following applications:

New Cases:

1. Suzanne Lerner-Hitzig Trust for the following variances of the Code of the Village of Sands Point: (1) Chapter 176 Article IV Section 176-27 A(2), to maintain a side yard setback of 25.2’ where 40’ is the minimum required and violate the required side yard sky plane by approximately 4.2’; (2) to maintain a garage after subdivision with a side yard setback of 4.8 feet where 20 feet is the minimum required on the property owned by them located at 35 Cornwells Beach Road in a Residence B District and known on the Nassau County Land & Tax Map as Section 4, Block C, Lot 15, 16 & 577.

2. Greg & Rachel Malsin for Site Plan Review pursuant to Chapter 132, Section 132-4A(1) of the Code of the Village of Sands Point to construct a new dwelling on property owned by them located at 10 Middle Road in a Residence A District and known on the Nassau County Land & Tax Map as Section 5, Block 73, Lot 829.

3. Greg & Rachel Malsin for a Fill Permit pursuant to Chapter 84 of the Code of the Village of Sands Point to move approximately 430 cubic yards of fill around the property and remove approximately 4,568 cubic yards of fill from the property related to the construction of a new dwelling on property owned by them located at 10 Middle Road in a Residence A District and known on the Nassau County Land & Tax Map as Section 5, Block 73, Lot 829.

4. Brian & Stephanie Ascher for Site Plan Review pursuant to Chapter 132, Section 132-4A(1) of the Code of the Village of Sands Point to construct a new dwelling on property owned by them located at 161 Sands Point Road in a Residence B District and known on the Nassau County Land & Tax Map as Section 4, Block C, Lot 51.

5. Brian & Stephanie Ascher for a Fill Permit pursuant to Chapter 84 of the Code of the Village of Sands Point to move approximately 1,957 cubic yards of fill around the property and remove approximately 120 cubic yards of fill from the property related to the construction of a new dwelling on property owned by them located at 161 Sands Point Road in a Residence B District and known on the Nassau County Land & Tax Map as Section 4, Block C, Lot 51.

6. Blake Bendett for Site Plan Review pursuant to Chapter 132, Section 132-4A(1) of the Code of the Village of Sands Point to construct a new dwelling on property owned by him located at 6 Astor Lane in a Residence A District and known on the Nassau County Land & Tax Map as Section 5, Block 115, Lot 29.

7. Blake Bendett for a Fill Permit pursuant to Chapter 84 of the Code of the Village of Sands Point to move approximately 995.5 cubic yards of fill around the property and to remove approximately 995.5 cubic yards of fill from the property related to the construction of a new dwelling on property owned by him located at 6 Astor Lane in a Residence A District and known on the Nassau County Land & Tax Map as Section 5, Block 115, Lot 29.

8. Baron & Mara Silverstein for a determination that the certain improvements comply with Chapter 66 of the Code of the Village of Sands Point, or, in the alternative, variances of Chapter 66, Section 66-13(B)(3) to allow the construction​/​maintenance of a gabion retaining wall and boulder wall within the coastal jurisdiction area, and Section 66-13(B)(5) to allow the runoff from the swimming pool area to be directed toward the bluff on property owned by them located at 32 Forest Drive in a Residence A District and known on the Nassau County Land & Tax Map as Section 4, Block 113, Lot 30.

Baron & Mara Silverstein for Site Plan Review Modification pursuant to Chapter 132, Section 132-4(C) of the Code of the Village of Sands Point related to the construction of a new dwelling on property owned by them located at 32 Forest Drive in a Residence A District and known on the Nassau County Land & Tax Map as Section 4, Block 113, Lot 30.

2. Baron & Mara Silverstein for a Fill Permit pursuant to Chapter 84 of the Code of the Village of Sands Point to move 600 cubic yards of fill around the property related to the construction of a new dwelling on property owned by them located at 32 Forest Drive in a Residence A District and known on the Nassau County Land & Tax Map as Section 4, Block 113, Lot 30.

The applications, plans and specifications are on file at the Office of the Village Clerk, 26 Tibbits Lane, Sands Point. At said time and place of Hearing as aforesaid stated all persons who wish to be heard will be heard.
