NOTICE OF PUBLIC

HEARING

429 MIDDLE NECK ROAD (Section 1, Block 190 Lot 1)

PLEASE TAKE NOTICE, that the Zoning Board of Appeals of the Village of Great Neck shall hold a public hearing on Thursday, August 1, 2019 at 7:30PM, at Village Hall, 61 Baker Hill Road, Great Neck, NY 11023 to hear the application of Temple Kol Yisrael Achim owner, represented by Robert Bahary, architect, for the premises at 429 Middle Neck Road in Great Neck. The applicant is seeking the following variance(s) from the Village Zoning Code:

1. § 575-111 Building Area.

B. The building area for all [non multi family dwelling and townhome] uses shall not exceed 35% of the lot area.

The property is 7,096 square feet. Thirty five percent of the lot area is 2,483 square feet. The applicant proposes to maintain a building area of 3,328 square feet, which represents 45% of the lot. A variance of 845 square feet or 13% of the lot area is required.

2. ß 575-112 Front Yards.

B. On a corner lot, a front yard shall be required on each street, each having a depth of not less than 15 feet from the property line and 21 feet from the curb, unless otherwise approved by the Board of Trustees.

The applicant proposes to maintain a front yard setback of ten feet from the property line, 20 feet-2 inches from the curb. As this was not approved by the Board of Trustees, a variance of five feet from the property line and ten inches from the curb is required.

3. ß 575-113 Side Yards.

The minimum side yard setback for each side yard shall be 10 feet, which area shall be landscaped, except for necessary access drives, parking, and walkways, in accordance with a plan approved as part of the site plan approval.

The applicant proposes to maintain side yard setbacks of 2 feet-7inches and 4 feet, which was not approved as part of the site plan. As such, variances of 7 feet-5 inches and 6 feet respectively, are required.

4. ß 575-114 Rear Yards.

There shall be a rear yard, the depth of which shall not be less than 25 feet.

The applicant proposes to maintain a ten foot rear yard setback. As such, a variance of fifteen feet is required.

The premises are also known as Section 1, Block 190, Lot 1 on the Nassau County Land and Tax Map, and are located in the Residence E or Apartment District, Middle Neck Road Multifamily Incentive Overlay District. A copy of the application materials is available for review in the Village of Great Neck Building Department, Village Hall, during regular business hours.
