The Board of Trustees of the Village of Kings Point will hold public hearings at 6:00 p.m., on March 2, 2021, at the Village Hall, 32 Steppingstone Lane, Kings Point, New York 11024, with respect to Bill 20A of 2020 and Bill 1 of 2021, which respectively reads, as follows:1. †Bill 20A of 2020, local law amending Chapter 100, Land Development, of the Code of the Village of Kings Point, to add a new section, ß 100-14, Waivers.Be it enacted by the Board of Trustees of the Village of Kings Point.Section 1. †Chapter 100, Land Development, of the Code of the Village of Kings Point, is hereby amended to add a new section, ß 100-14, Waivers, to read as follows:ìß 100-14. †Waivers.(1) Notwithstanding anything to the contrary in this chapter, any person who seeks to: (a) amend a previous decision of the Planning Board that was granted with regard to this Chapter; or(b) to change a grade that such person believes will have no adverse impact upon any neighboring properties or the public by appearance, aesthetics, drainage, or otherwise; †may seek a waiver of the Planning Boardís approval in accordance with the following procedure.(2) Waiver Procedure. †(a) Such person shall file with the Superintendent of the Building Department such documents as the Superintendent deems necessary to determine if there is a reasonable basis to granting the waiver.(b) If, in the sole discretion of the Superintendent, there is no reasonable basis to grant the waiver, the Superintendent shall deny the application.(c) If, in the sole discretion of the Superintendent, there may be a reasonable basis to grant the waiver, the Superintendent shall notify the Chairman of the Planning Board.(d) The Chairman shall then review the documents provided to the  Superintendent and may request any additional documents from the applicant as will assist in the review of the waiver application.(e) If, in the sole discretion of the Chairman, there is not sufficient reasonable † † †basis to the waiver, the Chairman shall deny the waiver.(f) If, in the sole discretion of the Chairman, there may be a reasonable basis to the waiver, the Chairman shall choose two other members of the Planning Board to assist in determining the waiver.(g) The Chairman and such other members of the Planning Board may, in their sole discretion, then grant the waiver, grant the waiver in part, or deny the waiver, and, upon any grant, in whole or in part, condition such grant upon terms they believe will eliminate, reduce, or mitigate any adverse impact by such grant.îSection 2. †Effective date. †This local law shall take effect immediately.2. †Bill 1C of 2021, A local law amending Article V, Provisions Applicable to All Districts, of Chapter 161, Zoning, of the Code of the Village of Kings Point.Be it enacted by the Board of Trustees of the Village of Kings Point.Section 1. †Article V, Provisions Applicable to All Districts, of Chapter 161, Zoning, of the Code of the Village of Kings Point, is hereby amended to add a new section, ß 161-36.2, Retention of Accessory Structures, to read as follows:ß 161-36.2. †Retention of Accessory Structures.A. A legal accessory structure that conforms to all of the then existing zoning requirements may be retained if the main building to which it is subordinate is demolished upon the  conditions that:(1)a building permit is issued within one year after said demolition for a new main  building to which it will be legally subordinate; and (2)  †such building permit is maintained in full force and affect until the new main  building is substantially constructed.B. A legal pre-existing nonconforming accessory tennis court or swimming pool that does not conform to all of the then existing zoning requirements may be retained if the main  building to which it is subordinate is demolished upon the conditions that: (3) a building permit is issued within one year after said demolition for a new main building to which it will be legally subordinate; and (4) such building permit is maintained in full force and affect until the new main building is substantially constructed.Section 2. †Effective date. †This local law shall take effect immediately.Persons who may suffer from a disability, which would prevent them from participating in said hearing, should notify Gomie Persaud, Village Clerk-Treasurer, at (516) 504-1000 in sufficient time to permit such arrangements to be made to enable such persons to participate in said hearing.Dated: †Kings Point, New York
