INCORPORATED VILLAGE OF LAKE SUCCESS

NOTICE IS HEREBY GIVEN THAT the Board of Trustees, at a remote public hearing held via the Zoom App on†March 8th, 2021, adopted the following Local Laws. †LOCAL LAW 5 of 2021 A LOCAL LAW authorizing a property tax levy in excess of the limit established in General Municipal Law ß3-c. LOCAL LAW 6 of 2021 A local law to adopt new Lake Success Code Chapter 99 entitled “Tree Preservation.î Section One.† Inc. Village of Lake Success Code Chapter 99 entitled “Tree Preservation,î section 9 entitled ìPenalties for offensesî subsection A is hereby repealed in its entirety and replaced with the following:1. Any person who shall violate any provision of this chapter shall be deemed guilty of a violation, and upon conviction thereof, the court may impose a fine of no less than $5,000†and no more than $10,000 per tree illegally removed, destroyed or substantially altered. The court, in addition to any penalties imposed, may order any person convicted of violating the provisions of this chapter to replace the tree(s) illegally removed, destroyed or substantially altered with the same species or agreed-upon alternate species having approximately the same diameter. Each such violation shall constitute a separate offense and shall be punishable as such hereunder.† Section Two.† If a court determines that any clause, sentence, paragraph, subdivision, or part of this local law or the application thereof to any person, firm or corporation, or circumstance is invalid or unconstitutional, the courts order or judgment shall not affect, impair, or invalidate the remainder of this local law, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this local law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered.† Section Three.† This local law shall take effect immediately upon filing with the Secretary of State. PLEASE TAKE FURTHER NOTICE†that due to public health and safety concerns related to the COVID-19 Pandemic, Village Hall is not open to the public.† In accordance with Governor Cuomoís Executive Order 202.1, the Village has limited Village Office Hours and public access to Village facilities to adhere to state-mandated social distancing to limit the spread of the virus.† Accordingly, Local Laws will not be available for inspection at Village Hall. This Local Law shall become effective upon filing with the Secretary of State. Dated:† March 10, 2021
