The Board of Trustees of the Village of Kings Point will hold public hearings at 6:00 p.m., on Monday, October 25, 2021, at the Village Hall, 32 Steppingstone Lane, Kings Point, New York 11024, with respect to Bills 14, 15A, and 16A of 2021, which read as follows:1. †Bill 14 of 2021, a local law amending Chapter 116, Penalties and Liability Through Accessorial Conduct, of the Code of the Village of Kings Point.Be it enacted by the Board of Trustees of the Village of Kings Point.Section 1. †Subdivision 1, of subsection A, of ß116-1, Penalties for offenses, of Chapter 116, Penalties and Liability Through Accessorial Conduct, of the Code of the Village of Kings Point, is hereby amended, to read as follows:ìA. Except as otherwise provided or supplemented, in whole or in part, in the Village Code and/or the New York State Vehicle and Traffic Law, any offense against any provision of the Village Code, or any other local law or ordinance of the Village, or of any resolution, rule, regulation, condition, or other determination or requirement of any Village Board, Village Commission, or Village Department, or direction or order of the Village Building Inspector or Village Engineer, shall be punishable by a fine not exceeding $1,000, imprisonment for not more than 15 days, or both such fine and imprisonment.îSection 2. †Effective date. †This local law shall take effect immediately.†2. †Bill 15A of 2021, a local law amending subsection F of ß117-2, Exterior maintenance, of Chapter 117, Property Maintenance, of the Code of the Village of Kings Point.Be it enacted by the Board of Trustees of the Village of Kings Point.Section 1. †ß117-2, Exterior maintenance, of Chapter 117, Property Maintenance, of the Code of the Village of Kings Point, is hereby amended, by amending subsection F and adding subsections P and Q, to read, respectively, as follows:ìF. Heavy undergrowth and the accumulation of plant growth which are unsightly, noxious, or detrimental to health shall be eliminated or removedî.ìP. Hedges and shrubs shall be kept pruned or trimmed.îìQ. Grass and weeds shall not exceed six inches in height.îSection 2. †Effective date. †This local law shall take effect immediately.3. †Bill 16A of 2021, a local law amending Chapter 137, Subdivision of Land, of the Code of the Village of Kings Point to require Community Benefit Fund fees.Be it enacted by the Board of Trustees of the Village of Kings Point.Section 1. †Chapter 137, Subdivision of Land, of the Code of the Village of Kings Point, is hereby amended, by adding a new Article VIII, Community Benefit Fund, to read as follows: ìARTICLE VIII††COMMUNITY BENEFIT FUNDß 137-34. †Community Benefit Fund.The Village hereby establishes a Community Benefit Fund, the purpose of which shall be to provide funds to benefit the residents of the Village by providing for landscaping, beautification, maintenance, and safety of Village property.ß 137-35. †Community Benefit Fund Fee.In addition to such other fees as may be required for the granting of a subdivision application, every grant of a subdivision shall include the requirement that the developer pay to the Community Benefit Fund two and one-half percent of the fair market value of all of the lots within the subdivision, based upon their value after the granting of the subdivision application, excluding, however, the fair market value of any buildings located thereon.ß 137-36. †Determination of Community Benefit Fund Fee.In the event that the applicant for the subdivision does not agree with the Planning Boardís determination of said fair market value, then, and in that event, at the option of the applicant, to be exercised within fifteen days after the Planning Boardís determination of said fair market value, the applicant may request in writing to the Village Clerk that the Planning Board engage an independent appraiser, at applicantís sole cost and expense, to be chosen by the Planning Board, to provide the Planning Board with an appraisal to assist it in its determination of said fair market value. †If said request is not received by the Village Clerk in writing within said fifteen-day period, the applicant’s option to obtain said appraisal shall be deemed waived.îSection 2. †Effective date. †This local law shall take effect immediately.Persons who may suffer from a disability, which would prevent them from participating in said hearing, should notify Gomie Persaud, Village Clerk-Treasurer, at (516) 504-1000 in sufficient time to permit such arrangements to be made to enable such persons to participate in said hearing.Dated: Kings Point, New York
