PLEASE TAKE NOTICE The Board of Trustees of the Village of Kings Point will hold public hearings at 6:00 p.m., on Monday, November 22, 2021, at the Village Hall, 32 Steppingstone Lane, Kings Point, New York 11024, with respect to Bills 17A and 18 of 2021, which read, respectively, as follows:1. †Bill 17A of 2021, a local law amending the Code of the Village of Kings Point with regard to required notices to property owners.Be it enacted by the Board of Trustees of the Village Kings Point.Section 1. †The Code of the Village of Kings Point is hereby amended by adding a new chapter 25, Notices to Property Owners, to read as follows:ìCHAPTER 25NOTICE TO PROPERTY OWNERSß 25-1. †Notice to property owners.A. Whenever an applicant to any board or commission of the Village is required to send a notice to property owners or others with regard to its application, such notice shall be sent by the applicant using a nationally recognized overnight courier service, for priority overnight next day delivery, without requiring a signature by the recipient. †Such notice shall be sent not more than 25 days nor less than 17 days before the date of the next meeting at which the application will be addressed. †B. The applicant shall file with the application:(1) a radius map showing all of the properties for which the notice is required to be served, with the tax map section, block, and lot numbers shown on the radius map; and(2) a list of the ownersí names and mailing addresses for all of the properties identified on the radius map, with the tax map designations for such properties. †If the property is within the Village, the applicant shall use the then current Village assessment roll for such information;C. Not less than 10 days prior to such meeting, the applicant shall file with the clerk of such board or commission:(1) an affidavit of service of the required notice; and(2) proof of delivery of each of such notices from the courier service.D. At the sole discretion of the board or commission to which the application is made, the failure to comply with any of the foregoing notice requirements may be waived.îSection 2. †Subsection D, of ß 161-83, Collocation requirements, of Article XII, Telecommunication Towers, of Chapter 161, Zoning, of said Code, is hereby amended, to read as follows:ìD. In order to keep neighboring municipalities informed, and to facilitate the possibility of directing that an existing tall structure or existing tower in a neighboring municipality be considered for shared use, an applicant shall send notice, as provided in Chapter 25 of this Code, to all of the village clerks of each village, the fire departments, and the water authorities within two miles of the proposed location of the tower. Such notification shall include the exact location of the proposed tower and a general description of the project, including but not limited to the height of the tower and its capacity for future shared use.î†Section 3. †Subdivisions 2 and 3, of subsection B, of ß 161-91, Procedural requirements, of said Article XII, are hereby amended, to read, respectively, as follows:ì(2) Notice of the public hearing shall be published in the official newspaper of the Village and sent by the applicant, as set forth in chapter 25 of this Code, to all property owners within 600 feet of the location of all proposed small wireless facilities.îì(3) In the event that any new locations are subsequently proposed, the applicant shall send notice, as provided in chapter 25 of this Code, to the property owners within 400 feet of the new location.î † † Section 4. †Effective date. †This local law shall take effect immediately.2. Bill 18 of 2021, a local law amending the Code of the Village of Kings Point with regard to referrals to and the powers of the Architectural and Preliminary Site Review Board.Be it enacted by the Board of Trustees of the Village Kings Point.Section 1. †Subsection A, of ß 161-54, Referrals, of Article IX, Architectural and Preliminary Site Review Board, of Chapter 161, Zoning, of the Code of the Village of Kings Point is hereby amended, to read as follows:ìA. Prior to the issuance of a building permit for the work described in either Subsection A(1), (2), or (3) below, the applicant shall file with the Secretary of the ARB an application for architectural and preliminary site approval of the plans for the proposed work.(1) Construction of a new building.(2) The alteration, addition to, or reconstruction of an existing building that would effect a significant change in the exterior appearance of a building. A change is deemed significant if the change in the facade involves an area equal to or in excess of 20% of the surface area of the wall or walls forming part of that facade as it exists prior to the commencement of any work or if the change in any one or more exterior walls in the building involves a surface area equal to or in excess of 10% of the surface area of all exterior walls of the building prior to the commencement of any work.(3) The alteration or replacement of a roof, in whole or in part, that would effect a significant change in the color, material, or other external appearance of the roof.îSection 2. †Subsections C and D, of ß 161-55, Standards for action, of Article IX, are corrected by changing the reference in each of said subsections from ìß 161-56î to ìß 161-51î.†Section 3. †Subdivision 3, of said subsection D, of said ß 161-55, is hereby amended by deleting the word ìorî at the end of subparagraph f and by adding new subparagraphs h, i, and j, to read, respectively, as follow:ì(h) Insufficient fenestration to avoid monotony of any faÁade;îì(i) Insufficient changes in the plane, detailing, setbacks of windows or doors, or other modifications to avoid monotony of any faÁade; orîì(j) Insufficient diversity of colors, textures, or materials to avoid monotony of any faÁade.îSection 4. †Said subsection D, of said ß 161-55, is hereby amended by adding a new subdivision 4, to read as follow:ì(4) Insufficient lighting in a front yard when appropriate for public safety reasons.îSection 5.
