NOTICE OF PUBLIC HEARING 118 Station Road (Section 1/Block 187/Lot(s) 24)PLEASE TAKE NOTICE, that the Zoning Board of Appeals of the Village of Great Neck shall hold a virtual public hearing via Zoom on Thursday, June 3, 2021 at 7:30PM at https://us02web.zoom.us/j/88356725404 or by calling 1 929 436 2866, Meeting ID 883 5672 5404. The Zoning Board of Appeals of the Village of Great Neck shall hear the application of Zev Geisinsky, agent, represented by Edna Guilor, architect, for the premises at 118 Station Road in Great Neck. The applicants are seeking the following variance(s) from the Village Zoning Codes: 1. ßSection 575-52 Building Area and Floor Area Ratio A. For single-family dwelling use, the building area shall not exceed 30% of the lot area and, subject to any modifications required by ß 575-167 of this chapter, the floor area ratio shall not exceed the limits hereinafter set forth. (1) On interior lots: 0.50 of the first 6,000 square feet of lot area; 0.20 of the lot area in excess of the first 6,000 square feet which is less than 100 feet from the street on which the lot abuts; and 0.10 of the lot area in excess of the first 6,000 square feet which is farther than 100 feet from said street. To the extent required, all of the area of the lot within 100 feet of the street on which the lot abuts must be included in the calculation of the first 6,000 square feet of lot area. The proposed floor area is 5,970.4 square feet, whereas 3,979.58 square feet is allowed. A variance of 1,990.82 square feet is needed. 2. ßSection 575-57 Side Yard A. On an interior lot, a single-family dwelling shall have two side yards, one on each side of the main building. The aggregate width of the two side yards shall not be less than 20 feet, plus 1/2 of the width of the lot in excess of 60 feet. No side yard shall have a width of less than eight feet, plus 2/5 of that portion of the minimum required aggregate width of both side yards in excess of 20 feet. Where practical, the wider of the two side yards shall be placed adjacent to the narrower of the side yards of an adjoining lot or lots. The proposed side yard setbacks for the new extension are below the required 12-foot distance from side property lines. The proposed north side yard is 7.6 feet and the proposed south side yard is 10 feet. Proposed HVAC units in the side yard do not conform with the minimum side yard. 3. ßSection 575-57 Side Yard A. On an interior lot, a single-family dwelling shall have two side yards, one on each side of the main building. The aggregate width of the two side yards shall not be less than 20 feet, plus 1/2 of the width of the lot in excess of 60 feet. No side yard shall have a width of less than eight feet, plus 2/5 of that portion of the minimum required aggregate width of both side yards in excess of 20 feet. Where practical, the wider of the two side yards shall be placed adjacent to the narrower of the side yards of an adjoining lot or lots. The proposed side yard is 17.6 feet, whereas a minimum of 30.005 feet is required. A variance of 12.4 feet is required. 4. ßSection 575-59 Permitted Encroachments A. The following encroachments into required yards are hereby permitted: (6) Unenclosed and unroofed platform and steps, designed to provide safe access to grade from service entrance doors, may extend not more than three feet six inches into a minimum side yard. The maximum horizontal surface of any encroaching platform shall not exceed 14 square feet. The side yard patio encroaches into the minimum side yard. A variance of 3.1 feet in needed. 5. ßSection 575-170.2 Outdoor Compressors F. Notwithstanding anything in Subsections B through E of this section to the contrary, outdoor compressors used in connection with air-conditioning systems shall be permitted as of right in a side yard so long as they meet all of the following conditions: (1) They must be located: (a) Within three feet of the dwelling; (b) Not less than five feet from the closest property line; and (c) At least 10 feet from the front-most portion of the wall of the dwelling along which they are placed. The proposed outdoor compressors are located less than five feet from the closest property line and require a variance. 6. ßSection 575-170.2 Outdoor Compressors F. (2) They must be certified by their manufacturers not to produce a continuous airborne sound level in excess of 60 dBA. In the event that there is more than one such compressor in a side yard, such certification must show that all such compressors, when running simultaneously, will not produce a continuous airborne sound level in excess of 60 dBA. The applicant has not produced documentation that the proposed outdoor compressors will not produce a continuous airborne sound level in excess of 60 dBA. The premises also known as Section 1, Block 187, Lot 24 on the Nassau County Land and Tax Map, and are located in the Residence B Zoning District. If anyone needs special accommodations for a disability, such person should contact the Village Clerk at least 5 days prior to the hearing.
