NOTICE IS HEREBY GIVEN THAT the Board of Trustees at a meeting held on October 15th, 2018
did duly adopt the following Local Law:
LOCAL LAW NO. 5 OF 2018
A LOCAL LAW to amend Lake Success Code Chapter 105, entitled ‘Zoning.’
BE IT ENACTED by the Lake Success Board of Trustees as follows:
Section One. Lake Success Code ß105-215 entitled ‘Establishment; membership’ is hereby amended to read as follows:
A Board of Appeals shall be appointed by the Mayor, with the approval of the Board of Trustees, pursuant to the Village Law of the State of New York. The Board of Appeals shall consist of five members. The Mayor, subject to the approval of the Board of Trustees, may appoint a secretary to the Board of Appeals to assist in performing its functions and may also provide for compensation to be paid to the secretary not exceeding the appropriation made by the board of trustees for such purpose.
Section Two. If a court determines that any clause, sentence, paragraph, subdivision, or part of this local law or the application thereof to any person, firm or corporation, or circumstance is invalid or unconstitutional, the courts order or judgment shall not affect, impair, or invalidate the remainder of this local law, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this local law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered.
Section Three. This local law shall take effect immediately upon filing with the Secretary of state.
