LEGAL NOTICE INCORPORATED VILLAGE OF LAKE SUCCESS 318 LAKEVILLE ROAD, GREAT NECK, NY 11020 NOTICE IS HEREBY GIVEN that the Lake Success Board of Trustees at a meeting held on December 14, 2020, at 7:30 p.m., via video-conferencing, did duly adopt the following Local Laws:Local Law 4 of 2020, a LOCAL LAW to amend Lake Success Code Chapter 42 entitled ìBuilding and Fire Prevention Code Administration Section One. Lake Success Code ß42-4 entitled ìBuilding permits.î, subsection A is hereby amended as follows: ß 42-4. ìBuilding permits.1. Building Permits required. Except as otherwise provided in Subsection B of this section, a building permit shall be required for any work which must conform uniform code and/or the Energy Code, including, but not limited to, the construction, enlargement, alteration, improvement, removal, relocation or demolition of any building or structure or any portion thereof, and the installation of a solid-fuel burning heating appliance, chimney or flue in any dwelling unit. No person shall commence any work for which a building permit is required without first having obtained a building permit from the Code Enforcement Officer. All work authorized by a duly issued building permit shall be performed only on weekdays from 8:00 a.m. to 5:00 p.m. and shall be strictly prohibited on weekends and Federal Holidays. †2. Section Two: If a court determines that any clause, sentence, paragraph, subdivision, or part of this local law or the application thereof to any person, firm or corporation, or circumstance is invalid or unconstitutional, the courts order or judgement shall not affect, impair or invalidate the remainder of this local law, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this local law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgement or order shall be rendered.†3. Section Three: This local law shall take effect immediately upon filing with the Secretary of State.Local Law 5 of 2020, A LOCAL LAW to amend Lake Success Code Chapter 67 entitled ìLandscape Garden Control.î Section One.† Lake Success Code ß67-4 entitled ìRegistration expired; exceptions,î subparagraph A, is hereby amended as follows: ß67-4.† Registration expired; exceptions.1. It shall be unlawful for any person to engage in or practice the trade or business of commercial landscape gardening within the corporate limits of the Village without having first registered with the Village pursuant to the requirements of this chapter or to apply pesticides or other chemicals without proof that they are licensed by the appropriate New York State agencies to apply pesticides and other chemicals.† A copy of said license shall be provided to the Building Department Clerk.††Section Two.† Lake Success Code ß67-6 entitled ìRegulationsî is hereby amended as follows:1. A gardener, landscaper or any other person, including the homeowner, shall not blow or rake leaves, grass or other debris onto any public highway or right-of-way or onto the property of any person nor cause or permit any person or entity to do the same.2. A gardener, landscaper or any other person, including the homeowner, shall not remove leaves, clippings or other yard waste in a truck, dump truck, van or other motor vehicle, trailer, container or other towable device without securing a tarpaulin or other covering to prevent accidental spillage.3. A gardener, landscaper or any other person, including the homeowner, shall not place any garbage, refuse, cuttings, leaves, wood or other materials upon any public highway or right-of-way or upon any public or private place or property except with the consent of the owner thereof nor cause or permit any other person or entity to do the same.4. A gardener, landscaper or any other person, including the homeowner, shall not spill or dump oil, gasoline or other petroleum products or any pesticides on the public highway or right-of-way or anywhere on the ground or on the property of any person nor cause or permit any other person or entity to do the same.5. A gardener, landscaper or any other person, including the homeowner, shall not fill or refill any machinery or equipment with any fuel or lubricant except over a drop cloth or other device designed to catch and retain any accidental spillage nor cause or permit any other person or entity to do the same6. A gardener, landscaper or any other person, including the homeowner, shall not remove any tree without first applying for a permit at the Village office pursuant to Lake Success Code, Chapter 99, entitled ìTrees, Preservation ofî which states in pertinent part that a permit is required for the removal of any tree with a trunk diameter of seven inches or greater measured four feet from ground level.7. A gardener, landscaper or any other person, shall not spray trees, plants or other foliage or otherwise apply pesticides or fertilizers on Saturday or Sunday.8. All gardening and landscaping shall be performed in accordance with the laws, ordinances, rules and regulations of the United States, the State of New York, the County of Nassau and the Village.9. A gardener, landscaper or any other person, including the homeowner, may perform landscaping, gardening or groundskeeping services on weekdays only from 8:00 a.m. to 5:00 p.m., and on Saturdays only from 9:00 a.m. to 2:00 p.m.† No such services shall be performed on a Federal holiday.10. A gardener, landscaper or any other person, including the homeowner, shall not operate or permit the operation of any equipment which emits unusually loud or unnecessary noise nor cause or permit any other person to do the same in violation of Lake Success Code, Chapter 75, entitled ìNoiseî which states in pertinent part that lawnmowers, leaf blowers and other similar machines are permitted on weekdays only from 8:00 a.m. to 5:00 p.m. and Saturdays from 9:00 a.m. to 2:00 p.m.11. A gardener, landscaper or any other person, including the homeowner, shall not operate or permit the operation of any equipment which emits excessive fumes nor cause or permit any other person to do the same.12. A gardener, landscaper or any other person, including the homeowner, shall not burn any wastepaper, rubbish, leaves, cuttings, wood or other waste materials at any time nor cause or permit any other person to do the same.† This shall not prevent a homeowner from burning wood in a fireplace or firepit.13. No gardener and landscaper or any other person shall apply or spray pesticides or fertilizers on any properties within the Village unless they have been approved by the appropriate Federal, State or local agencies and have provided the Village with copies of all required permits and licenses as set forth in Lake Success Code ß67-4(A).Section Three:† If a court determines that any clause, sentence, paragraph, subdivision, or part of this local law or the application thereof to any person, firm or corporation, or circumstance is invalid or unconstitutional, the courts order or judgment shall not affect, impair, or invalidate the remainder of this local law, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this local law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered.†Section Four.† This local law shall take effect immediately upon filing with the Secretary of State.Local Law 6 of 2020, a LOCAL LAW to amend Lake Success Code Chapter 75 entitled ìNoiseîSection One. Lake Success Code ß75-1 entitled ìGeneral prohibitionsî is hereby amended as follows:It shall be unlawful for any person, firm or entity to make, continue, or cause or permit to be made or continued any loud, raucous, unnecessary or unusual noise or any noise which either annoys, disturbs interferes with, injures or endangers the comfort, repose, health, peace or safety of others within the limits of the Village.Section Two: Lake Success Code ß75-2 entitled ìEnumeration of prohibited acts,î subsection H (1) is hereby amended as follows:ß75-2 H. Power Tools†1. The use of any power tool, lawn mower, leaf blower or similar machine which makes a sound audible beyond the property line of the premises where it is used is permitted on weekdays only from 8:00 a.m. to 5:00 p.m. and Saturdays only from 9:00 a.m. to 2:00 p.m. and is expressly prohibited on Sundays and Federal Holidays.2. Section Three:† If a court determines that any clause, sentence, paragraph, subdivision, or part of this local law or the application thereof to any person, firm or corporation, or circumstance is invalid or unconstitutional, the courts order or judgment shall not affect, impair, or invalidate the remainder of this local law, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this local law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered.†3. Section Four.† This local law shall take effect immediately upon filing with the Secretary of State.4. A copy of these proposed Local Laws are available for inspection at the Village Office by appointment weekdays between the hours of 9:00 a.m. and 4:30 p.m.This Local Law shall become effective upon filing with the Secretary of State.
