NOTICE OF PUBLIC HEARING

PLEASE TAKE NOTICE, that the Zoning Board of Appeals of the Village of Great Neck shall hold a virtual public hearing via Zoom on Thursday, April 1, 2021 at 7:30PM at https://us02web.zoom.us/j/88356725404 or by calling

The Zoning Board of Appeals of the Village of Great Neck shall hear the application of Joseph Rahmani and Ashley Kahalili, applicants, represented by Paul Bloom, attorney, for the premises at 136 Maple Street in Great Neck. The applicants are seeking the following variance(s) from the Village Zoning Codes:
1. ßSection 575-9 Building Area and Floor Area Ratio
A. For single-family dwelling use, the building area shall not exceed 20% of the lot area and, subject to any modifications required by ß 575-167 of this chapter, the floor area ratio shall not exceed the limits hereinafter set forth:
Building lot area is 22,500 sq.ft. x 20% = 4,500 sq.ft. maximum allowable coverage. The total coverage of main dwelling and attached raised rear patio is 3,859.37 sq.ft. The total coverage of the cabana with overhang is 1307.12 sq.ft. The total building area coverage is 5,166.49 sq.ft., whereas the maximum coverage allowable by Village of Great Neck Zoning Code is 4,500 sq.ft. A variance of 666.49 sq.ft. is required.
1. §Section 575-9 Building Area and Floor Area Ratio
A (1) On interior lots: 0.33 of the first 10,500 square feet of lot area; 0.20 of the lot area in excess of the first 10,500 square feet which is less than 150 feet from the street on which the lot abuts; and 0.10 of the lot area in excess of the first 10,500 feet which is farther than 150 feet from said street. To the extent required, all of the area of the lot within 150 feet of the street on which the lot abuts must be included in the calculation of the first 10,500 square feet of lot area.
The maximum floor area ratio allowed is 4,740 sq.ft. by the Village of Great Neck Zoning Code. The dwelling is 4,959.3 sq.ft. and and has already received a variance for 219.3 sq.ft. The cabana accessory building is 495.62 sq.ft. and requires an additional variance. The cabana overhang is not calculable for floor area ratio.
1. §Section 575-155 Parking in Residence Districts
J. Single-family, two-family, and three-family detached dwellings.
(1) As used in this subsection, the following terms shall have the following meanings:
ORIGINAL FLOOR AREA
The floor area of the dwelling on the date when the construction of the dwelling was first completed or on the date five years before the instant application whichever was the last date to occur.
REQUIRED PARKING
(a) Off-street parking spaces for the greater of the following:
[1] Three vehicles;
[2] One vehicle for the second and one additional vehicle for every additional room which could be used as a bedroom (for example, five bedrooms would require four parking spaces);
The dwelling has four bedrooms on the second floor, one room on the first floor (office with full bathroom), and two rooms in the basement (gym and computer room with egress windows). These rooms all qualify for parking space requirements. Four parking spaces are provided, whereas six spaces are required by Village of Great Neck Zoning Code. A variance of two parking spaces is required.
4. § 575-153 Accessory Swimming Pools.
B. All swimming pools and their appurtenances shall conform to such requirements as the Superintendent of the Building Department shall prescribe as conditions to the granting of any application for a permit therefor, as to, among other things, height, area, and setback requirements, which in no event shall be less than the following:
(3) No part of the pool, its deck or appurtenances shall be located less than 20 feet from any lot line of the premises or 40 feet from any residential building on any adjoining lot.
The changes made to the location of the jacuzzi tub to the south side of the pool and property line is located 16.3 feet from the property line. The Village of Great Neck Zoning Code requires a minimum of twenty feet from any property lines. A variance of 3.7 feet is needed.
1. §Section 575-147 Fences: Height, Special Exception Permits and Additional requirements
2. E. Except as otherwise expressly provided in this code, fences only shall be made of the following materials: wood, composite materials that have the appearance of wood, metal picket fences, or such other material as may be approved by the Board of Trustees or the Committee of Architectural Review on a case-by-case basis.
The approved fence was a four-foot high estate style fence. The owner has installed a four-foot high chain link fence. The fence is not a permitted style, and requires a variance from the Village of Great Neck Zoning Code.
The premises also known as Section 1, Block 60, Lot 68 on the Nassau County Land and Tax Map, and are located in the Residence AA Zoning District.
If anyone needs special accommodations for a disability, such person should contact the Village Clerk at least 5 days prior to the hearing. At said hearing, all parties and interests will be given an opportunity to be heard.
