NOTICE OF PUBLIC HEARING

2 MORELAND COURT (Section 1/Block 201​/​Lot 99)

PLEASE TAKE NOTICE, that the Zoning Board of Appeals of the Village of Great Neck shall hold a public hearing on Thursday, November 7, 2019 at 7:30PM at Village Hall, 61 Baker Hill Road, Great Neck, NY 11023, to hear the application of Robert and Elaine Mordekhai, owners, represented by Paul Bloom, attorney, for the premises at 2 Moreland Court in Great Neck. The applicants are seeking site plan approval and the following variance(s) from the Village Zoning Codes:

§ Section 575-80 Building Area and Floor Area Ratio

For single-family dwelling use, the building area shall not exceed 35% of the lot area and, subject to any modifications required by § 575-167 of this chapter, the floor area ratio shall not exceed the limits hereinafter set forth:

(2) On corner lots: 0.50 of the first 5,000 square feet of lot area; and 0.15 of the lot area in excess of the first 5,000 square feet.

Based on the size of the proposed two-story house the permitted FAR is 2,784 sq. ft. The proposed FAR is 3,297.8 sq. ft, which is 513.8 sq. ft greater than permitted.

§ Section 575-84 Front Yards

A corner lot shall have a front yard on each public street on which the lot abuts. All front yards shall have a minimum depth equal to the greater of 20 feet or the average depth of the front yards of other lots which are on the same block front and within 200 feet. In no event, however, shall a front yard be required to have a depth which is greater than 35 feet.

This property is located on a corner lot, which requires two front yards. The required front yard setback on Moreland Court, based on average 200 feet is 21 linear feet. The proposed setback is 18.17 linear feet which is 2.83 linear feet shy of the required 21 linear feet.

§ Section 575-86 Rear Yards

There shall be a rear yard, the depth of which shall be 25 feet plus 1/4 of the depth of the lot in excess of 100 feet.

The required rear yard is 25 linear feet. The proposed setback is 24.67 linear feet.

ßSection 575-87 Permitted Encroachments

The following encroachments into required yards are hereby permitted:

(2) Bay windows not more than six feet in length and one story high, three feet deep.

The allowed bay window encroachment length in the rear yard is 6 linear feet. The proposed length is 9.25 linear feet.

The premises also known as Section 1, Block 201, Lot 99 on the Nassau County Land and Tax Map, and are located in the Residence C Zoning District. A copy of the application material is available for review in the Village of Great Neck Building Department, Village Hall, during regular business hours.
