HEARING

733-741 MIDDLE NECK ROAD (S​/​B/L 1/1/5, 106, 115, 212)

PLEASE TAKE NOTICE, that the Zoning Board of Appeals of the Village of Great Neck shall hold a public hearing on Thursday, August 1, 2019 at 7:30PM, at Village Hall, 61 Baker Hill Road, Great Neck, NY 11023 to hear the application of Joseph Shemtov of Gesher Community, LLC, owner, represented by Paul Bloom, Harras, Bloom & Archer, attorney, for the premises at 733-741 Middle Neck Road in Great Neck. The applicant is seeking the following variance(s) from the Village Zoning Code:

1. § 575-77 Use

The proposed building is a split zone property. It will be located in the Residential E Zone and the Residential C Zone.

As per § 575-77, the portion of the building located in the Residence C Zone is a non-listed, non-permitted use.

2. § 575-77 Use

A building may be erected, altered or used and a lot or premises may be used for any of the purposes set forth in this section and for no other:

A.Single-family detached dwelling.

The portion of the proposed multifamily building located in the C Zone will be four stories and accommodate 34 apartments.

3. § 575-78 Height.

The maximum height of a building located in the Residential C District shall not exceed 30 feet or 22 feet at the eaves.

The proposed height of the four-story building is 42 feet.

4. § 575-84 Front Yards

All lots shall have at least one front yard. A corner lot shall have a front yard on each public street on which the lot abuts. All front yards shall have a minimum depth equal to the greater of 20 feet or the average depth of the front yards of other lots which are on the same block front and within 200 feet.

The proposed front yard in the Residence C portion is ten feet.

5. § 575-86 Rear Yards

There shall be a rear yard, the depth of which shall be 25 feet plus 1/4 of the depth of the lot in excess of 100 feet.

The proposed rear yard in the Residence C portion is ten feet.

6. § 575-106 Height. ​​ Portion of the building in Residence E Zone

B. The maximum height for a multifamily dwelling located in the Residence E Zone shall not exceed 31 feet.

The application will require a resolution from the Board of Trustees for a development incentive to allow four floors for a 42 foot height.

BZA approval shall be subject to the merging of lots 212 and 115 with lot 5 and lot 106.

The premises are also known as Section 1, Block 1, Lots 5, 106, 115, 212 on the Nassau County Land and Tax Map, and are located in the Residential E or Apartment District, Middle Neck road Multifamily Incentive Overlay District. A copy of the application materials is available for review in the Village of Great Neck Building Department, Village Hall, during regular business hours.
