ZONING BOARD OF APPEALS

NOTICE OF PUBLIC HEARING

2 OLD TREE LANE (Section 1/Block 142​/​Lot 95)

PLEASE TAKE NOTICE, that the Zoning Board of Appeals of the Village of Great Neck shall hold a public hearing on Thursday, August 1, 2019 at 7:30PM at Village Hall, 61 Baker Hill Road, Great Neck, NY 11023, to hear the application of Nick Hakimian, owner, represented by Paul Bloom, attorney and Edward Dickman, architect, for the premises at 2 Old Tree Lane in Great Neck. The applicants are seeking site plan approval and the following variance(s) from the Village Zoning Codes:1. §Section 575-170.2 Outdoor Compressors

B. Location. Outdoor compressors used in connection with air-conditioning systems shall be located in the rear yard immediately adjacent to the rear wall of the residence and at least 20 feet from any property line.

The proposed A/C units are located in the front yard, 20 feet from the property line.

2. §Section 575-52 Building Area and Floor Area Ratio

A. (2) On corner lots: 0.50 of the first 6,000 square feet of lot area; and 0.15 of the lot area in excess of the first 6,000 square feet.

The allowed FAR is 3250.7 square feet. The proposed FAR is 3440.3 square feet, 189.6 square feet greater than the allowed FAR.

3. §575-53 Lot Width and Lot Depth

B. On a corner lot:

(1) A minimum lot width of 65 feet shall be maintained from the lesser of the street lines of both public streets for the first 100 feet of lot depth or 30 feet beyond that point of construction of the principal building that is located farthest from such street line, whichever distance is greater.

The allowable lot width is 65 feet and at 100 feet, the existing lot width is 57 feet at 100 feet.

4. §Section 575-56 Front Yards

A corner lot shall have a front yard on each public street on which the lot abuts. All front yards shall have a minimum depth equal to the greater of 25 feet or the average depth of the front yards of other lots which are on the same block front and within 200 feet.

The minimum allowed front setback is 25 feet, the proposed setback is 20 feet on the longer street frontage.

5. §Section 575-57 Side Yards

B. On a corner lot, a single-family dwelling shall have only one side yard abutting an interior lot adjacent thereto. Said side yard shall have a minimum width of 10 feet, plus 2/5 of the width of the lot in excess of 65 feet measured in the same direction. The side yard shall be on the side adjoining the interior lot opposite the front yard having the greater street frontage.

The minimum allowed side yard is 10 feet, the proposed is 8 feet.

The premises also known as Section 1, Block 142, Lot 95 on the Nassau County Land and Tax Map, and are located in the Residence B Zoning District. A copy of the application material is available for review in the Village of Great Neck Building Department, Village Hall, during regular business hours.
