Fallorino wins big verdict

East Williston resident Robert Fallorino, a lawyer with Pegalis and Erickson, has won a judgment in a medical malpractice suit of $15 million, the Lake Success law firm announced on Tuesday.

Pegalis and Erickson said the case is fourth highest verdict amount in New York State in 2012 for medical malpractice, and the 10th highest for all overall verdicts in New York State, according to Verdict Search, publisher of verdict and settlement news and research. Their publication, Top New York Verdicts, ranks the highest obtained verdicts of 30 law practice categories from all of New York State. 

The case involved a mother on Long Island whose radiologist, Dr. Paul Fisher, of Stonybrook University Medical Center, failed to diagnose cancerous tumors in her breast, according to Pegalis and Erickson. 

The suit contended Dr. Fisher failed to order a breast sonogram which would have allowed for earlier detection. The jury found that Fisher departed from an accepted standard of medical care, according to Pegalis and Erickson.

A recent study published in the journal, Radiology, in February 2013, found that the majority of medical malpractice lawsuits are filed against radiologists because they failed to detect breast cancer.

Fallarino has more than 20 years experience handling complex labor law, product defects and medical malpractice litigation. He is also vice president of the East Williston Board of Education.
