NOTICE IS HEREBY GIVEN that the BOARD OF ZONING APPEALS of the INCORPORATED VILLAGE OF EAST HILLS has scheduled a meeting and public hearings via videoconference pursuant to Governor’s Executive Order 202.1 for June 16, 2020 at 4:00 PM to consider the following:

JOSHUA STEIN requests ONE VARIANCE for the property known as 125 Crescent Lane designated as Section 7 Block 133 Lot 7 on the Nassau County Land and Tax map and within the R2 District of the Village. Pursuant to East Hills Code §271-47(b), Accessory buildings and uses, accessory structures must be located at least five feet from the rear lot line and ten feet from the side lot line. The rear yard patio is located on the side yard property line. Therefore a variance is requested for ten feet of side yard setback.

BETH ELIAS requests modification of the swimming pool that is the subject of the August 17, 1964 decision of the Zoning Board of Appeals for the property known as 42 Tara Drive, designated as Section 19 Block 40 Lot 10 on the Nassau County Land and Tax map and within the R1 District of the Village. All changes to an existing Special Exception must be presented to the Zoning Board of Appeals for approval. Therefore, the Applicants request consideration by the Board of Appeals.

SHARA MAVROSON requests SEVEN VARIANCES for the property known as 57 Laurel Lane, designated as Section 7 Block 114 Lot 79 on the Nassau County Land and Tax map and within the R2 district of the Village. Pursuant to East Hills Code § 271-232, Height Setback Ratio, the proposed work encroaches into the required height setback ratio for the front yard and variances are requested for 7 foot height setback encroachments on the Laurel Lane and on the Deerpath sides of the premises. Pursuant to East Hills Code § 271-233, Height Setback Ratio, the proposed work encroaches into the required height setback ratio for the right side yard and a 9.5 foot variance is requested. Pursuant to East Hills Code §271-235, Floor Area, the maximum permitted floor area for the property is 3,969.75 sf. The proposed floor area is 4,580.5 sf and a 610.75 square feet of floor area variance is requested. Pursuant to East Hills Code §271-236(A), Exterior Wall Interruption, no combined new and existing front or side wall can extend to a length of more than 30 feet without a change or break of at least 2 feet. The right side first floor elevation wall extends to a length of 50 feet without a break. The right side second floor wall and the left side second floor wall each extend to a length of 44 feet without a break. Therefore, 20, 14, and 14 foot variances are requested for the right side first and second floor elevation walls and for the left side second floor elevation wall, respectively.

ROBERT AND LORI OLAN request a SPECIAL EXCEPTION AND EIGHT VARIANCES for the property known as 138 ANDOVER ROAD designated as Section 7 Block 215 Lot 28 on the Nassau County Land and Tax Map and within the R2 District of the Village. Pursuant to East Hills Code §271-139(A), swimming pools require a special exception from the Zoning Board of Appeals. Pursuant to East Hills Code §271-143(A)(6), a pool drywell is to be separate, not interconnected and a variance is requested. Pursuant to East Hills Code § 271-14 (A), the maximum allowable fence height is 4 feet. Pursuant to East Hills Code § 271-143(A)(1) and (3), pool enclosure fences must be of the chain link type, and be erected completely enclosing the pool at least five feet from the edge of the pool and at least 15 feet from any property line. Therefore, variances are requested for a proposed 5 foot fence, located along the property line. Pursuant to East Hills Code §271-14(A), Fences, no fences are permitted to be erected within the front yard and a variance is requested for a proposed front yard fence. Pursuant to East Hills Code §271-142(F), no swimming pool of permanent or plastic construction shall be installed and​/​or used in a front or side yard of any residential premises. The proposed pool is located in the side yard and front yards and variances are requested. Pursuant to East Hills Code §271-47 (B), accessory buildings and uses, accessory buildings shall be located in the rear yard. The proposed accessory building is in the front yard. Therefore, a variance is requested.

CRESCENZO VENEZIANO requests FOUR VARIANCES and modification of the Zoning Board of Appeals decision of December 3, 2019 that approved an application for a Special Exception for a swimming pool for the property known as 385 CHESTNUT DRIVE, designated as Section 7 Block 264 Lot 18 on the Nassau County Land and Tax map and within the R1 District of the Village. A March 30, 2020 fence permit application requests changes to the previously approved location and type of fencing and consideration by the Board of Appeals is requested. Pursuant to East Hills Code §271-14 (A), the maximum allowable fence height is 4 feet. Pursuant to East Hills Code §271-143(A)(1) and (3), pool enclosure fences must be of the chain link type, be erected completely enclosing the pool at least five feet from the edge of the pool and at least 15 feet from any property line, with only one gated ingress and egress. The proposed five foot fence is of the estate type, located on the property line, and has two gates. Therefore, variances are requested.
