PUBLIC HEARING NOTICE

PLEASE TAKE NOTICE that a public hearing will be held as to the following matter:

Place:Village Hall, 100 East Shore Road, Thomaston,

New York

Subject: Application of Sandy Chen, 3 Valley View Road, Thomaston, New York, to construct a rear two (2) story addition and alterations to the residence, which requires variances of the following Village Code sections: (a) Village Code ß203-36(B), in that the floor area will be 56%, where a maximum of 40% is permitted; (b) Village Code ß203-99(A)(1), in that the proposed construction increases the following non-conformities, where no such increase is permitted, in that the alteration to the second floor (increase in height) will: (i) be 21 feet from the front property line, where the existing dwelling is 21 feet from the front property line, and Village Code ß203-37(A) requires a minimum setback of 25 feet; (ii) be 2.2 feet from the side property line, where the existing dwelling is 2.2 feet from the side property front line, and Village Code ß203-37(C)(2) requires a minimum setback of 5 feet; (iii) have an aggregate side yard setback of 12.37 feet, where the existing dwelling has an aggregate side yard setback of 12.37 feet, and Village Code ß203-37(C)(2) requires a minimum aggregate side yard setback of 16.5 feet; (c) Village Code ß203-122(A), in that the air conditioning equipment will be located 12 feet from a side property line, where a minimum of 20 feet is required; and (d) Village Code ß203-126(B), in that the driveway width will be 8.91 feet, where a minimum of 10 feet is required. Premises are designated as Section 2, Block 175, Lot 9 on the Nassau County Land and Tax Map.

At the said time and place, all interested persons may be heard with respect to the foregoing matter.

This application is a Type II Matter under the State Environmental Quality Review Act, which requires no environmental review.

Any person having a disability which would inhibit attendance at or participation in the hearing should notify the Village Clerk at least three business days prior to the hearing, so that reasonable efforts may be made to facilitate such attendance and participation.

All relevant documents may be inspected at the office of the Village Clerk, 100 East Shore Road, Thomaston, New York, during regular business hours.
